The website https://mysilkcart.com/(“Website”) and the Silk Cart application (“Application”) (the Website and Application together constitute the “Platform”) is owned and operated by VSamagra (“Silk Cart”), a partnership firm incorporated and registered under the laws of India and having its office at #129, Vsspc complex, 3rd floor, Govindappa road, Basavanagudi, Bangalore – 560004, India. Through the Platform, Silk Cart seeks to facilitate the listing, exhibiting, and offering for sale of silkworm seeds (“Product”), reared and sold by licensed farmers (“Sellers”), to users of the Platform (“Users’).
The terms ‘Silk Cart’ or ‘us’ or ‘we’ refer to the owners of the Platform. The terms ‘you’ or ‘user’ and its grammatical variations, refer to the Users.
This Privacy Policy (“Policy”) reflects Silk Cart’s commitment towards protecting the privacy and personal information provided by Users and sets out the nature and type of information the Silk Cart collects from Users for the purpose of sale of the Products, the usage and disclosure of such information, and the safety and security measures adopted by Silk Cart to safeguard such information.
Please note that the Policy is specifically applicable to the Users of the Platform, and the information and data gathered on or through the Platform and is not applicable to any other information or platform, unless otherwise stated. You are hereby advised to read the Policy carefully and fully understand the nature and purpose of gathering and/ or collecting sensitive, personal and other information and the usage, disclosure and sharing of such information. By requesting and consenting to purchase the Products, you hereby also consent to the company sharing information with Sellers on the Platform and any third-party vendors and service providers engaged by Silk Cart for the purpose of operating the Platform and selling the Products. You also consent to the transfer and/or storage of your Personal Information (as defined herein) and data in accordance with applicable laws.
Terms not defined herein will have the meaning ascribed to them in Silk Cart’s Terms and Conditions of Use for the Platform, as available at https://mysilkcart.com/terms-conditions-2/ (“Terms and Conditions of Use”)

This Policy explains:

1. PURPOSE AND USAGE
We collect and use your Personal Information in order to operate, provide, develop and improve the Platform services that are offered to the Users through the Platform. Without prejudice to the generality of the foregoing, the purposes for which we may use your Personal Information include:
- Taking and fulfilling Orders, processing payments and communicating with you about your Orders and Products listed on the Platform.
- Improving functionality, analysing performance, fixing errors, and improving the suability and effectiveness of the Platform.
- Recommending other products that might be of interest to you, identifying your preferences and personalizing and enhancing your experience with the Platform.
- Stock update and tracking to effectively manage your inventory;
- Complying with applicable laws as required;
- To analyze and improve the safety and security of our services – we do this as it is necessary to pursue our legitimate interests in ensuring that the Platform is secure, such as by implementing and enhancing security measures and protections and protecting against fraud, spam and abuse.
- Safeguarding Users from online threats, including preventing and detecting fraud and abuse.
2. INFORMATION GATHERED
As a User, you can only access the Platform if you are a registered farmer, who possesses a license in accordance with the guidelines of the Central Silk Board, India without which you cannot successfully register onto the Platform. You will only be able to login with the credentials stated above, and cannot create any new accounts thereafter. Additionally, once logged in, you will have to confirm that you have read and agreed to the Policy on the Platform’s Terms and Conditions of Use available at https://mysilkcart.com/terms-conditions-2/.
Information we collect from you at registration shall include the following:
- Name
- Valid Bank Account details
- A valid AADHAR/ Pan card/ Driving License or Voter ID.
- Mobile number
- Company Name
- Company Address
- Landline Number
- Bank Details
- Email Address
- Central Silk Board, India issued valid license number.
You may add or update certain information, in which case we may keep a copy of the prior version of our records.
In addition, we may collect demographic information such as information about your mobile device, computer, tablet, hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage and click paths and other data that you may provide in surveys while completing your account profiles. We may combine demographic information with Personal Information to tailor our offerings or web pages to your preferences or interests.
We retain your Personal Information in accordance with appliable laws, for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain data related to you if we believe it may be necessary to prevent fraud or future abuse, to enable Silk Cart to exercise its legal rights and/or defend against legal claims or if required by law or for other legitimate purposes. We may continue to retain your data in anonymised form for analytical and research purposes.
We will provide you with the option to withdraw consent that you have already provided with respect to the collection of your Personal Information. Such option may be exercised by you, by writing to us at vsamagra2022@gmail.com, or in such other manner as may be specified on the Platform. Please note, however, that withdrawal of consent will not be retroactive and will be in accordance with the terms of this Policy, the Terms and Conditions of Use and applicable laws. However, in the event that you opt out of providing your Personal Information as specified hereinabove, you may no longer be able to access certain features of the Platform.
Users are entitled to request Silk Cart to delete their user account and their Personal Information by sending an email with their written request to vsamagra2022@gmail.com. We will assess and determine the course of action for each such request from a user on a case-by-case basis. Please note that if you request the deletion of your Personal Information, we may retain your Personal Information in line with what is stated above.
You can delete your account by following the instructions provided on the Platform. Please note that we may need to verify your identity in connection with your requests, and such verification process may, if you do not have access to your Account, require you to provide us with additional information we maintain about you to verify your identity. Even if you have access to your Account, we may request additional information if we believe it’s necessary to verify your identity. If we are unable to verify your identity, we may not be able to fulfil your request for deletion of your account. When you request deletion of your data, we follow a deletion process that ensures that your data is safely and completely removed from our servers or retained only in anonymized form. We try to ensure that our services protect information from accidental or malicious deletion. Due to this, there may be delays between when your request for deletion and when copies are deleted from our active and backup systems.
You are entitled to request certain copies of your Personal Information or information about how we handle your Personal Information, request copies of Personal Information that you have provided to us in a structured, commonly used, and machine-readable format, and/or request that we transmit this information to another service provider, where technically feasible.
3. PERSONAL INFORMATION
Personal Information means any information that may be used to identify you and that is not otherwise publicly available, including, but not limited to, your first and last name, place of residence, email address, mobile number, government issued ID, bank account details or other contact information. (“Personal Information”)
We may collect Personal Information from you when you register and create a profile on the Platform to view the Products. Further, in the case of Users purchasing any Products, we may use such Personal Information in order to verify your credentials, keeping track of your Orders and providing you with solutions from industry experts.
We may use Personal Information and other information received and collected from you to facilitate your communication with Sellers in relation to the Products that you are interested in, to enable you to access and update your profile on the Platform or any part thereof, and to contact you upon your request and when otherwise necessary. We may also use Personal Information for auditing, research and analysis, and to operate and improve the Platform and the Products listed on the Platform. In certain circumstances, we may share aggregated non-personal information with third parties. When we use third parties to assist us in processing your Personal Information, we require that they comply with our Policy and any other appropriate confidentiality and security measures. We may also share such information with third parties in limited circumstances, including when complying with legal process, preventing fraud or imminent harm, acting against claims of infringement of third-party rights, ensuring the security of our network and services, protecting the rights, property and safety of Users or the general public, and otherwise enforcing compliance with the Terms and Conditions of Use and the Policy.
4. DISCLOSURE/ SHARING
Silk Cart may also share information as provided by you and your data concerning usage of the Platform with the Sellers who have listed Products on the Platform, as well as with third party service providers engaged by Silk Cart, for the purpose of data analytics or other similar purposes, and improving the Products and helping Silk Cart serve you better. Provided that any affiliate and third-party service provider (as may be applicable) with whom the information is shared will be required, on best efforts basis, to comply with the same standards as applicable to us in relation to maintaining the security and confidentiality of the information provided by you.
By using the Platform, you hereby expressly agree and grant consent to the collection, use and storage of your Personal Information by Silk Cart. Silk Cart reserves the right to share, disclose and transfer Personal Information collected hereunder with its own affiliates. These affiliates may use such information for the purpose of informing you of their products and services and may market to you as a result of such sharing unless you explicitly opt-out as provided on the Platform. In the event Silk Cart sells or transfers all or a portion of its business assets, or merges with or is acquired by another entity, your Personal Information may be shared, disclosed or transferred as part of the transaction, provided that the entity with which the information is shared or the combined new entity (in the case of a merger) will be required, on best efforts basis, to comply with the standards of this Policy, in respect of the usage of your Personal Information. You hereby expressly grant consent and permission to Silk Cart for disclosure and transfer of your Personal Information to such third parties. Further, Silk Cart reserves the right to disclose Personal Information as obligated by law, in response to duly authorized legal process, governmental requests and as necessary to protect the rights and interests of Silk Cart.
Where we propose to use your Personal Information for any other purposes, we will ensure that we notify you first. You will also be given the opportunity to withhold or withdraw your consent for the use of your Personal Information, other than as listed above or elsewhere in this Policy.
5. SENSITIVE PERSONAL INFORMATION
Sensitive Personal Information (“SPI”) means such personal information which consists of information relating to your financial information (such as bank account details or credit card numbers) and such other information specified as constituting SPI under the applicable laws of India.
Except for any SPI that you shall be required to provide as part of your registration on the Platform or in the course of transacting on the Platform, namely your government issued ID and your bank account details, Silk Cart does not collect any SPI in the course of listing the Products for sale. Any SPI collected by Silk Cart shall not be disclosed to any third party without your express consent, save as otherwise set out in this Policy or the Terms and Conditions of Use or as provided in a separate written agreement between Silk Cart and you or as required by law. It is clarified that this condition shall not apply to publicly available information, including SPI, in relation to you on the Platform.
However, you acknowledge that in the course of providing the Products, Silk Cart may receive SPI, either when you voluntarily choose to update your profile with information related to your identity, physical and physiological condition, or from such content posted by you on the Platform, and you hereby consent and agree to allow Silk Cart to store and display the SPI collected in this manner on the Platform and disclose it in accordance with the terms of this Policy.
It is clarified that with respect to any SPI that you may share with Silk Cart, you have the sole right to determine whether you want to share such information with Silk Cart. Further, with respect to any SPI that you may share in the course of updating your profile, you have the right to determine the levels of access to such information, by adjusting the privacy settings of your account with the Platform. However, you will not be able to participate in transactions related to Products on the Platform, if you choose not to provide the personal information required by Silk Cart.
6.COOKIES AND OTHER TRACKING TECHNOLOGIES
Some of our web pages may also utilize “cookies” and other tracking technologies or tools. A “cookie” is a small text file that may be used, for example, to collect information about your activity on our Platform. Some cookies and other technologies may serve to recall Personal Information previously indicated by you. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. you may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you may need to re-enter your Personal Information to gain access to certain parts of our Platform. Additionally, you may encounter “cookies” or other similar devices on certain pages of the Platform that are placed by third parties. We do not control the use of cookies by third parties.
Tracking technologies may automatically record information such as Internet domain and host names; other information about your geographic location; IP addresses; browser software and operating system types; CPU/mobile type; your manner of connecting to the Internet (e.g., connection speed through narrowband or broadband access); click paths; and dates and times that our Platform is accessed. Such information does not identify the User personally.
Our use of cookies and other tracking technologies allows us to improve our Platform and consequently your experience using the Platform and purchasing the Products. Cookies can also help us provide information with respect to your interests. We may also analyze information that does not include Personal Information for trends and statistics.
7. CONFIDENTIALITY AND SECURITY
We will keep confidential and protect your SPI and Personal Information, except where disclosure is required or permitted by law or in instances where use and disclosure thereof is permitted under this Policy.
We follow generally accepted industry standards to protect the SPI and Personal Information submitted to us, both during transmission and, once we receive it, for storage and disposal. All information we gather is securely stored within databases controlled by us. The databases are stored on servers secured behind a firewall; access to the servers is password protected and is strictly limited. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your Personal Information and SPI, we cannot guarantee its absolute security.
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of Our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data.
Information gathered by Silk Cart is stored securely using several information security applications including firewalls. However, security is always relative, and Silk Cart cannot guarantee that its security measures are absolute and cannot be breached. Data, which is transmitted over the internet, is inherently exposed to security risks or threats. For instance, information transmitted via email can be compromised and used by others. Therefore, Silk Cart cannot guarantee any security for such information in the course of transmission through the internet infrastructure or any unsolicited disclosures made by any User availing the services of the Platform. By using the Platform, you understand and agree that your information may be used in or transferred to countries other than India.
We limit access to SPI and Personal Information to employees/personnel/Sellers/service providers/representatives who we believe reasonably need to come into contact with that information to provide the Products to you or in order to do their jobs.
Third party Sellers provide the Products available on our Platform. We may provide information, including Personal Information, to Sellers and third-party service providers/representatives to facilitate the sale and delivery of Products, as well as to help us deliver information and services efficiently and effectively. Service providers are also an important means by which we maintain our Platform and mailing lists. We will take reasonable steps to ensure that the Sellers and third-party service providers/representatives are obligated to protect Personal Information on our behalf through confidentiality agreements and otherwise. We do not intend to transfer SPI and Personal Information without your consent to third parties who are not bound to act on our behalf unless such transfer is legally required. Similarly, it is against our policy to sell SPI and Personal Information collected online without consent.
When you register with us, your account is protected by means of login information, which includes a one-time password sent to the mobile number provided by you, that is known only to you. Therefore, you should not provide your Personal Information to anyone whosoever and breach hereof constitutes violation of this Policy and can also result in closure of your account in certain cases. If you become aware of or reasonably suspect any breach of security, including compromise of your login information, it is your responsibility to immediately notify us at vsamagra2022@gmail.com.
8. THIRD PARTY PLATFORMS
If you click on a link to a third-party site or otherwise leave the Platform, you will go to a platform that is outside the purview of our control. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your Personal Information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. The use of Personal Information by such platforms shall be governed by the privacy policies provided therein. Therefore, if you visit a third-party platform that is linked to our Platform, you should consult that platform’s privacy policy before providing any Personal Information.
9. CHILDREN INFORMATION
Use of our Platform is available only to persons who are above eighteen (18) years of age, are of sound mind, are not disqualified from contracting by any law to which the persons are subject and can provide the information which is stated above. We do not knowingly solicit or collect personal information from children under the age of eighteen (18) years. In the event that we learn that we have collected Personal Information from a child below the age of eighteen (18) years, we will delete that information as quickly as possible. 10. CONDITIONS OF USE
Silk Cart does not warrant that this Platform, its servers, or emails sent by us or on our behalf are virus free. Silk Cart will not be liable for any damages of any kind arising from the use of this Platform, including, but not limited to compensatory, direct, indirect, incidental, punitive, special and consequential damages, loss of data, goodwill, business opportunity, income or profit, loss of or damage to property and claims of third parties.
11. CONTACTING YOU
We may contact you using the Personal Information you have given us:
- To facilitate any of your Product transactions on the Platform;
- Where you have opted to receive further correspondence;
- To invite you to participate in surveys, opinion polls, etc., about our services or otherwise (participation is always voluntary); and
- To provide you information about new Products and new services, where you have specifically agreed to receive this.
- To keep a track of the quality of the products by checking yield percentage.
12. ACCURACY
To the extent that you do provide us with Personal Information and SPI, we wish to maintain accurate and current SPI and Personal Information. Where we collect SPI and Personal Information from you on our Platform, should you need to update or correct that SPI and Personal Information, please contact us and we will make reasonable efforts to incorporate the changes in your SPI and Personal Information that we hold as soon as practicable. You can obtain the information we currently hold on you by emailing Silk Cart at vsamagra2020@gmail.com from the email address provided to Silk Cart at the time of registration on the Platform. We will use our best efforts to send you the information within 14 days of receipt of your email.
13. TERMINATION OF USER ACCOUNT
In the event that you choose to terminate and delete your user account with Silk Cart in respect of the Platform, or if your account has been terminated for any other reason, such as a violation of the Terms and Conditions of Use, your Personal Information may be retained and may continue to be used until: (i) the relevant purposes for the use of your information described in this Policy are no longer applicable; and (ii) we are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain your Personal Information and the retention of your Personal Information is not required for the establishment, exercise or defence of any legal claim.
14. LIMITATION OF LIABILITY
Silk Cart confirms that this Policy is only a description of its operation regarding your Personal Information and SPI. This Policy is not intended to and does not create any legal rights in your favour or in the favour of any other person. Silk Cart reserves the right to change this Policy at any time without giving you prior notice. Any changes to our Policy will be posted on this page, so you are always aware of what information we collect, how we use it, how we store it and under what circumstances we disclose it. The liability of Silk Cart shall be limited to removal of SPI from the system of the Platform and removal of personally identifiable elements in accordance with the Policy.
15. CONSENT AND AMENDMENTS
By using this Platform, you consent to the terms of this Policy and to our use and management of Personal Information and SPI for the purposes and in the manner herein provided. Should this Policy change, we intend to take every reasonable step to ensure that these changes are brought to your attention by posting all changes prominently on our Platform for a reasonable period of time. Your visit and any dispute over privacy are subject to this Policy.
16. DATA PROTECTION OFFICER
In accordance with applicable law the name and the details of the Data Protection Officer has been published and is available on the Platform here. Silk Cart reserves the right to replace the Data Protection Officer at its discretion through publication of the name and title of such replacement on the Platform, which replacement shall come into effect immediately upon publication.

17. APPLICABLE LAW
The Policy shall be governed by and construed in accordance with the laws of the Republic of India. Further, it is irrevocably and unconditionally agreed that the courts of Bengaluru, India shall have exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same.
